If a husband and wife apply to the Association for accommodation they will usually be given a joint tenancy – this means that they have an equal share in the tenancy. This may also applies in the case of sisters/brothers or friends who have agreed to share the accommodation ie. equal rights and responsibilities. If one partner leaves or dies then the remaining partner will be become the sole tenant.
If a sole tenant dies then the tenancy will automatically pass onto any other adult member of his/her family who has lived with the tenant for twelve months before the death and has no other home. This arrangement is known as a succession of tenancy and must be approved by the Association.
The right of succession only applies once.
If the accommodation is designed for older people (over 60) and/or those registered disabled, the person succeeding would have to qualify for this type of accommodation for the right to succeed to exist.
Anyone claiming the right to succeed must notify us in writing, within one month of tenant’s death.
